Senator Martinez of Florida said the judge's ruling last week was a "death warrant" for Mrs. Schiavo, and compared the legislation's added layer of judicial review to the appeals that are available to prisoners on death row.

So, I went to law school with a lot of congressional staffers. My *favorite* story is when a staffer was working on something and the Senator came into the office, asking "I need ammo to argue against bill [x] - who's got anything?"

My friend said "Uh, it's unconstitutional?"

The Senator, startled, said "oh, that's good! Thanks!"

I later looked up the bill. It was patently unconstitutional. Got argued down in committee.

But why do Congressmen have to be *told* this? Of course, the root of the problem is the lack of constitutional education in elementary school. Can you *imagine* if we taught fifth graders and up how to read the Constitution and what the various parts meant, then contrasted it with modern society? Wow.
